মার্কিন যুক্তরাষ্ট্রের সিনেট ইন্টেলিজেন্স কমিটির CIA সংক্রান্ত রিপোর্ট এবং 'স্বচ্ছ, নিরপেক্ষ, আন্তর্জাতিক মানের' হিপক্রিসি

আমাদের মহান মুক্তিযুদ্ধ চলাকালীন সময়ে পাকিস্তানের দালাল রাজাকার/আল বদর নেতাদের যুদ্ধাপরাধের বিচারকে প্রশ্নবিদ্ধ করার প্রচেষ্টার অগ্রদূত হল মার্কিন যুক্তরাষ্ট্র সরকারের কিছু প্রভাবশালী সদস্য। আন্তর্জাতিক যুদ্ধাপরাধ ট্রাইবুনালের অধীনে চলামান এই বিচারের শুরু থেকেই পুরো প্রক্রিয়া নিয়ে এরা নানা বিভ্রান্তিকর বক্তব্য দিয়ে আসছেন এবং হস্তক্ষেপ করার চেষ্টা চালিয়ে গেছেন। মার্কিন রাষ্ট্রপতি বারাক ওবামার যুদ্ধাপরাধ বিষয়ক বিশেষ দূত স্টিফেন জে র‌্যাপ এবং সহকারী পররাষ্ট্র মন্ত্রী নিশা দেসাই বিসওয়াল বাংলাদেশে কয়েকবার এসেছেন এবং প্রত্যেকবার ‘মার্কিন সরকার যুদ্ধাপরাধের বিচার চায় কিন্ত...’ গোছের বক্তব্য দিয়েছেন। এসব বক্তব্যে বিচারের স্বচ্ছতা ও নিরপেক্ষতা নিয়ে প্রশ্ন তোলা হয়েছে, বিচার আন্তর্জাতিক মানের হচ্ছে কিনা এবং এর গ্রহণযোগ্যতা নিয়ে সন্দেহ প্রকাশ করা হয়েছে, আসামীদের মানবাধিকার লঙ্ঘন করা হচ্ছে কিনা তা নিয়ে উদ্বেগ জানান হয়েছে, জামায়াতে ইসলামীর যুদ্ধাপরাধীদের দল হিসেবে বিচার না করার ‘পরামর্শ’ দেয়া হয়েছে, যুদ্ধাপরাধীদের সর্বচ্চ শাস্তি মৃত্যুদণ্ড না হয়ে যাবজ্জীবন কারাদন্ড করা যায় কিনা না তা নিয়ে দেন দরবার করা হয়েছে। এমনকি কাদের মোল্লার মত জঘন্য নরপিশাচ যুদ্ধাপরাধীর মৃত্যুদণ্ড কার্যকর করা ঠেকাতে খোদ মার্কিন পররাষ্ট্র মন্ত্রী জন কেরি প্রধানমন্ত্রী শেখ হাসিনাকে ফোন করেছিলেন। বলাই বাহুল্য বাংলাদেশের যুদ্ধাপরাধীদের বিচারের মান ও তাদের মানবাধিকার নিয়ে উন্নত বিশ্বের কাণ্ডারি, স্বঘোষিত ‘leader of the free world’ মার্কিন যুক্তরাষ্ট্র অনেক চিন্তিত।

মঙ্গলবার মার্কিন সিনেট ইন্টেলিজেন্স কমিটি যুক্তরাষ্ট্রের গুপ্তচর সংস্থা CIA (Central Intelligence Agency) এর উপর করা এক তদন্তের রিপোর্ট প্রকাশ করেছে। তদন্তটি ছিল ২০০১ সাল থেকে ইসলামী জঙ্গিদের বিরুদ্ধে চালিয়ে যাওয়া যুক্তরাষ্ট্রের ‘War on Terror’ এর যুদ্ধবন্দীদের প্রতি CIAর আচরন নিয়ে। বেশ কয়েক বছর ধরেই CIA এর বিরুদ্ধে অভিযোগ আছে যে তারা যুদ্ধবন্দীদের জিজ্ঞাসাবাদ করার সময় সিস্টেম্যাটিকভাবে নির্যাতন করে এসেছে। CIA বরাবর এই অভিযোগ প্রত্যাখ্যান করেছে এই দাবী করে যে প্রথমত যুদ্ধবন্দীদের নির্যাতন ব্যাপক প্রসারিত ছিল না, দ্বিতীয়ত বন্দীদের তখনই নির্যাতন করা হয়েছে যখন সেই নির্যাতন রাষ্ট্রীয় নিরাপত্তা রক্ষার খাতিরে জায়েজ ছিল। দেখা যাক পুরো প্রক্রিয়া কতটুকু স্বচ্ছ, নিরপেক্ষ, মানবিক ও আন্তর্জাতিক মানের ছিল।

স্বচ্ছতা

New York Times কাগজে প্রকাশিত “Senate Torture Report Faults C.I.A for Brutality and Deceit” শিরোনামের প্রতিবেদন (http://www.nytimes.com/2014/12/10/world/senate-intelligence-committee-cia-torture-report.html) থেকেঃ

“The Senate committee’s investigation, born of what its chairwoman, Senator Dianne Feinstein of California, said was a need to reckon with the excesses of this war, found that C.I.A. officials routinely misled the White House and Congress about the information it obtained, and failed to provide basic oversight of the secret prisons it established around the world.”

“The report also suggests that more prisoners were subjected to waterboarding than the three the C.I.A. has acknowledged in the past. The committee obtained a photograph of a waterboard surrounded by buckets of water at the prison in Afghanistan commonly known as the Salt Pit, a facility where the C.I.A. had claimed that waterboarding was never used. One clandestine officer described the prison as a “dungeon,” and another said that some prisoners there “literally looked like a dog that had been kenneled.”

“The report said that senior officials — including former C.I.A. directors George J. Tenet, Porter J. Goss and Michael V. Hayden — repeatedly inflated the value of the program in secret briefings both at the White House and on Capitol Hill, and in public speeches.”

“The report also said that the C.I.A.’s leadership for years gave false information about the total number of prisoners held by the C.I.A., saying there had been 98 prisoners when C.I.A. records showed that 119 men had been held. In late 2008, according to one internal email, a C.I.A. official giving a briefing expressed concern about the discrepancy and was told by Mr. Hayden, then the agency’s director, “to keep the number at 98” and not to count any additional detainees.”

বোঝাই যাচ্ছে যে এই জিজ্ঞাসাবাদ প্রক্রিয়া কতটুকু স্বচ্ছ ছিল।

নিরপেক্ষতা

উপরে উদ্ধৃত একই প্রতিবেদন থেকেঃ

“According to the Senate report, even before the agency captured its first prisoner, C.I.A. lawyers began thinking about how to get approval for interrogation methods that might normally be considered torture. Such methods might gain wider approval, the lawyers figured, if they were shown to save lives.
‘A policy decision must be made with regard to U.S. use of torture,’ C.I.A. lawyers wrote in November 2001, in a previously undisclosed memo titled ‘Hostile Interrogations: Legal Considerations for C.I.A. Officers.’
The lawyers argued that “states may be very unwilling to call the U.S. to task for torture when it resulted in saving thousands of lives.’”

“The committee’s report concluded that of the 119 detainees, ‘at least 26 were wrongfully held.’ It said, ‘These included an ‘intellectually challenged’ man whose C.I.A. detention was used solely as leverage to get a family member to provide information, two individuals who were intelligence sources for foreign liaison services and were former C.I.A. sources, and two individuals whom the C.I.A. assessed to be connected to Al Qaeda based solely on information fabricated by a C.I.A. detainee subjected to the C.I.A.’s enhanced interrogation techniques.’”

প্রথম যুদ্ধবন্দী হাতে আসার আগেই যেখানে CIA কিভাবে তাদের জিজ্ঞাসাবাদের পদ্ধতিকে জনসমক্ষে ‘গ্রহণযোগ্য’ ও ‘প্রশ্ন/সমালচনার ঊর্ধ্বে’ রাখা যায় সেই কৌশল ঠিক করতে তৎপর ছিল, সেখানে পুরো প্রক্রিয়া কতটুকু নিরপেক্ষ ছিল তা নিয়ে অবশ্যই সন্দেহ জাগে। আরও বলে রাখা উচিত, এই ‘War on Terror’ এর বেশীরভাগ যুদ্ধবন্দী কিন্তু পৃথিবীর আনাচে কানাচে CIA নিয়ন্ত্রিত গুপ্তকারাগারে বিচারহীন অবস্থায় আছে। এদের ‘enemy combatant’ হিসেবে আখ্যা করা হয়েছে বলে সাধারন কয়েদীদের যেসব অধিকার প্রাপ্য তা থেকে এরা বঞ্চিত। এ থেকেও এইসব যুদ্ধবন্দীদের প্রতি কতটুকু নিরপেক্ষ আচরণ করা হচ্ছে তা নিয়ে প্রশ্ন তোলা যায়।

মানবতা

বাংলাদেশের যুদ্ধাপরাধ আসামীদের সাথে ‘মানবিক’ আচরন করা হচ্ছে কিনা সে ব্যাপারে মার্কিন সরকার র‌্যাপ সাহেব বিসওয়াল সাহেবা প্রমুখের মাধ্যমে একাধিকবার উদ্বেগ প্রকাশ করেছে। সেই মার্কিন সরকারের অধিনস্থ গুপ্তচর সংস্থা CIA যুদ্ধবন্দীদের সাথে কতটুকু মানবিক আচরন করে এসেছে তার কিছু নিদর্শন মিলে New York Times এর প্রতিবেদন থেকেঃ

“In exhaustive detail, the report gives a macabre accounting of some of the grisliest techniques that the C.I.A. used to torture and imprison terrorism suspects. Detainees were deprived of sleep for as long as a week, and were sometimes told that they would be killed while in American custody. With the approval of the C.I.A.’s medical staff, some prisoners were subjected to medically unnecessary “rectal feeding” or “rectal hydration” — a technique that the C.I.A.’s chief of interrogations described as a way to exert “total control over the detainee.” C.I.A. medical staff members described the waterboarding of Khalid Shaikh Mohammed, the chief planner of the Sept. 11 attacks, as a “series of near drownings.”

“The torture of prisoners at times was so extreme that some C.I.A. personnel tried to put a halt to the techniques, but were told by senior agency officials to continue the interrogation sessions.”

“During one waterboarding session, Abu Zubaydah became ‘completely unresponsive with bubbles rising through his open, full mouth.’ The interrogations lasted for weeks, and some C.I.A. officers began sending messages to the agency’s headquarters in Virginia questioning the utility — and the legality — of what they were doing. But such questions were rejected.
‘Strongly urge that any speculative language as to the legality of given activities or, more precisely, judgment calls as to their legality vis-à-vis operational guidelines for this activity agreed upon and vetted at the most senior levels of the agency, be refrained from in written traffic (email or cable traffic),’ wrote Jose A. Rodriguez Jr., then the head of the C.I.A.’s Counterterrorism Center. ‘Such language is not helpful.’”

আর আমাদের দেশের যুদ্ধাপরাধীরা জেলে বসে ‘ইসলামী’ বই লিখে, ফুলের বাগান চাষ করে, উস্তা ভাজি খাওয়ার খায়েস করে (যা আবার মেটানও হয়), মরার দিন পর্যন্ত হাসপাতালের ভিএইপি কেবিনে ‘চিকিৎসাধীন’ অবস্থায় থাকে সখের টকঝালমিষ্টি আচার খেতে খেতে। নাহ, আমরা খুবই অমানবিক।

আন্তর্জাতিক মান
CIA এর জিজ্ঞাসাবাদ এবং নির্যাতন কতটুকু আন্তর্জাতিক মানসম্পন্ন/গ্রহণযোগ্য ছিল তা যাচাই করা যাক সিনেট কমিটির রিপোর্ট নিয়ে কিছু প্রতিক্রিয়া দেখে। New York Times এ “Overseas, Torture Report Prompts Calls for Prosecution” শিরোনামে প্রকাশিত আরেকটি প্রতিবেদন (http://www.nytimes.com/2014/12/10/us/politics/overseas-torture-report-prompts-calls-for-prosecution.html) থেকেঃ

“Jordan J. Paust, a professor at the University of Houston Law Center, said the report ‘adds another layer of proof of serial international criminality that was manifestly authorized” during President George W. Bush’s two terms in office.’ In a commentary on Jurist.org, Professor Paust said both the Convention Against Torture and the 1949 Geneva Conventions require the United States to prosecute or extradite any person ‘reasonably accused of having criminal responsibility’ for the documented instances of torture.”

“Kenneth Roth, the executive director of Human Rights Watch, said in a statement on the organization’s website that the Senate report ‘should forever put to rest C.I.A. denials that it engaged in torture, which is criminal and can never be justified.’
He added, ‘Unless this important truth-telling process leads to prosecution of officials, torture will remain a ‘policy option’ for future presidents.’”

“Prime Minister David Cameron of Britain, reacting to the report, was contrite about what he described as mistakes made after the Sept. 11, 2001, attacks that spawned the Bush administration’s war on terror, in which the British government was a close partner.
Asked about the report at a news conference while visiting Turkey, Mr. Cameron said, ‘After 9/11 there were things that happened that were wrong — and we should be clear about the fact that they were wrong.’”

“’It makes no difference,’ said Nazeeh Alemad, a legal adviser for Yemen’s longtime ruling political party. ‘People here are not looking for more proof of torture” by the United States, he said. “They deal with it as a fact.’”

CIA ‘War on Terror’ চলাকালীন সময়ে কতটুকু স্বচ্ছ, নিরপেক্ষ, মানবিক ও আন্তর্জাতিক মান রক্ষা করে এসেছে তার একটি নিদর্শন আজ দেখা গেল। এখানে উল্লেখযোগ্য, ৬০০০ পৃষ্ঠার এই সিনেট কমিটির রিপোর্ট এর শুধু ৫২৪ পৃষ্ঠা প্রকাশ করা হয়েছে, বাকি এখনও ক্লাসিফাইড। মার্কিন রাষ্ট্রপতি বারাক ওবামা যে এই অংশবিশেষও প্রকাশ করতে নির্দেশ দিয়েছেন, তা অবশ্যই প্রশংসনীয়। তারপরেও বলব, ইংরেজিতে একটা প্রবাদ আছে, “People in glass houses should not throw stones.” যেটা মার্কিন সরকারের বেলায় খাটে। বাংলাদেশের যুদ্ধাপরাধের প্রক্রিয়া এবং যুদ্ধাপরাধীদের মানবাধিকার নিয়ে এত উতলা না হয়ে নিজের সরকারের অতি গুরুত্বপূর্ণ সংস্থা CIA কে সংশোধন করতে সময় ব্যয় করলে বোধহয় বেশী ভালো হয়। নিজেরা স্বচ্ছ, নিরপেক্ষ ও আন্তর্জাতিক মান বজায় রাখতে চরম ব্যর্থতা দেখিয়ে অন্য একটি স্বাধীন সার্বভৌম রাষ্ট্রকে এই ব্যাপারে লেকচার দেয়াটা আসলে একটা বড় রকমের হিপক্রিসি।
